Reinstitution of the Statewide Non-Residential Development Fee Effective July 1, 2013
As AHPNJ previously reported on September 19th, a major recent development in the affordable housing arena was the Governor’s conditional veto of an amendment to the Municipal Land Use Law which would have extended the moratorium on the 2.5% affordable housing fee on non-residential development. The Governor indicated that he would extend the moratorium if it were part of more sweeping legislation similar to a bill which the New Jersey Senate passed in June 2010 known as S-1 (as in Senate Bill No. 1).
While it is not possible to predict whether the Legislature will turn its attention to the Governor’s conditional veto, in the meantime all municipalities should continue to impose and collect the required mandatory state-wide 2.5% affordable housing development fee from all non-residential development. AHPNJ will continue to monitor this proposed legislation.
