Extending Affordability Controls: Process, Compliance, and Documentation

Participants will learn the proper procedures for notifying owners of a municipality's intent to extend controls, including the required certified mail and email notice timelines. The workshop will also address the practical challenges of bringing units up to code prior to extending affordability controls, including strategies and lessons learned from communities that have navigated this process. Finally, attendees will review the control documents that must be filed to effectuate an extension, including the new deed restriction in the form prescribed at N.J.A.C. 5:80-26 Appendix E for rental units, the applicable deed restriction and restrictive covenant forms for ownership units, and the requirement that all extensions comply with the current UHAC requirements to receive credit under the Fair Housing Act.
